TERMS & CONDITIONS
These Terms of Trade apply to all quotations, sales, and supply of goods and services by PACMachinery AU (“we”, “us”, “our”) to any customer (“you”, “the purchaser”). By placing an order, issuing a purchase order, paying an invoice, or accepting delivery of goods, you agree to these Terms of Trade.
1. Application of Terms
1.1 These Terms of Trade apply to all goods and services supplied by PACMachinery AU unless we agree otherwise in writing.
1.2 Any terms provided by you that conflict with these Terms are excluded unless expressly accepted by us in writing.

2. Quotations & Pricing
2.1 All quotations are valid for 14 days from the date of issue unless otherwise stated.
2.2 Prices are exclusive of GST, freight, insurance, installation, and commissioning unless otherwise specified in writing.
2.3 We may correct any clerical, typographical, or arithmetic errors in quotations, order confirmations, invoices, or other documents.

3. Orders & Acceptance
3.1 An order is deemed accepted when:

We confirm it in writing; or
-
Goods are dispatched to you.
3.2 Orders cannot be cancelled or varied without our prior written consent.
3.3 We may charge a cancellation fee where costs have been incurred due to your cancellation or change.

4. Payment Terms
4.1 Unless you have an approved credit account, payment is required in full prior to dispatch.
4.2 For approved credit accounts, payment terms are 30 days from invoice date, unless otherwise agreed in writing.
4.3 We may suspend or cancel supply if any amount is overdue.
4.4 Interest may be charged on overdue amounts at 2% per month, together with reasonable recovery costs.

5. Title & Risk
5.1 Risk in the goods passes to you upon:
-
Delivery to your premises; or
-
Collection by your nominated carrier.
5.2 Title to the goods remains with PACMachinery AU until we receive full payment in cleared funds.
5.3 Until title passes, you:
-
Hold the goods as bailee for us;
-
Must keep the goods identifiable and in good condition;
-
Authorise us to enter your premises to recover goods if you default in payment.
6. Delivery
6.1 Any delivery time or date provided is an estimate only.
6.2 We are not liable for any loss or damage arising from delay in delivery due to freight issues, customs, supplier delays, or events beyond our control.
6.3 You must inspect goods on delivery and notify us in writing within 48 hours of any visible damage, error, or discrepancy.
7. Returns
7.1 No goods may be returned without our prior written authorisation (RMA).
7.2 Unless required by law, returns are only accepted if:

Goods are unused and undamaged;
-
In original packaging;
-
Returned within the timeframe stated on the RMA.
7.3 Special-order, customised, or clearance items are non-returnable, except where required under the Australian Consumer Law (ACL).
7.4 We may charge a restocking fee of up to 20% of the invoiced amount for non-defective returns.
8. Taxes & Duties
8.1 Unless stated otherwise, all prices are exclusive of GST.
8.2 You are responsible for all applicable taxes, duties, import charges, and other government levies.
9. Installation & Commissioning
9.1 Installation, wiring, programming, and commissioning are not included unless expressly quoted and agreed in writing.
9.2 All electrical work must be carried out by a licensed electrician or appropriately qualified technician.
9.3 Incorrect installation or wiring may void warranty and may result in equipment damage or hazard.
10. Force Majeure
10.1 We are not liable for any delay or failure to perform our obligations where caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, war, transport disruption, supplier failure, or government actions.
11. Governing Law
11.1 These Terms of Trade are governed by the laws of Australia.
11.2 You submit to the non-exclusive jurisdiction of the courts of the state or territory in which PACMachinery AU operates.
This Warranty Policy applies to all goods supplied by PACMachinery AU (“we”, “us”, “our”). PACMachinery AU is not an authorised distributor of the original manufacturer, and therefore the manufacturer’s factory warranty does not apply. PACMachinery AU provides its own limited warranty as outlined below.
1. Warranty Period
1.1 All goods supplied by PACMachinery AU are covered by a 12-month limited warranty, beginning on the date the goods are dispatched from our warehouse.
1.2 The warranty duration does not restart or extend if the product is repaired or replaced under warranty.
1.3 Evidence of dispatch date (tracking, invoice, or dispatch confirmation) determines the warranty start date.
2. Warranty Coverage
This warranty covers:

Defects in materials or workmanship that appear during normal operation
-
Failure under proper installation and correct usage
-
Replacement part or repair (at PACMachinery AU’s discretion)
This is a parts-only warranty unless otherwise agreed in writing.
3. What the Warranty Does NOT Cover
The PACMachinery AU warranty does not apply to damage caused by:

Incorrect installation, wiring, programming, configuration
-
Use outside rated voltage, temperature, or load specifications
-
Use with incompatible equipment or accessories
-
Overload, short-circuit, or insufficient protection devices
-
Misuse, neglect, mechanical impact, vibration, or contamination
-
Lightning, surge, power quality issues
-
Liquid ingress, corrosion, dust contamination
-
Normal wear and tear
-
Consumables (fuses, lamps, relays, connectors, etc.)
This warranty also excludes:
-
Labour, travel, or technician costs
-
Removal or re-installation
-
Lost production, downtime, or financial losses
4. Warranty Claim Procedure
To make a claim:
4.1 You must contact PACMachinery AU in writing and provide:
-
Model number and serial number (if applicable)
-
Invoice number
-
Description of the issue
-
Photos or videos if relevant
4.2 PACMachinery AU may issue an RMA (Return Material Authorisation).
4.3 Goods must be returned to PACMachinery AU (or a nominated facility) at the customer’s cost for evaluation.
4.4 If a fault is confirmed and covered, PACMachinery AU will repair or replace the item.
4.5 If the fault is not covered (e.g., installation error), inspection and return freight charges may apply.
5. No Manufacturer Warranty
Because PACMachinery AU is not an authorised distributor:

Manufacturer warranties do not apply
-
Manufacturers do not accept returns, repairs, or warranty cases
-
Warranty is handled exclusively by PACMachinery AU or its service partners
6. Dead-On-Arrival (DOA)
If a product fails immediately upon first use or within 7 days of delivery:

Notify PACMachinery AU immediately
-
DOA units will receive priority assessment
-
Replacement depends on stock availability
-
DOA may be rejected if damage is due to incorrect installation or misuse
7. Out-of-Warranty Options
If the 12-month period has expired, or damage is excluded:
-
Repair may still be available as a paid service
-
A quote will be provided before proceeding
8. Limitation of Liability
To the maximum extent permitted by Australian law:
-
PACMachinery AU is not liable for indirect, special, or consequential losses
-
This includes downtime, lost production, or financial loss
-
Our total liability is limited to the purchase price of the goods
Nothing in this policy excludes rights under the Australian Consumer Law (ACL).
9. Australian Consumer Law
Under the ACL, customers may be entitled to statutory guarantees that cannot be excluded. These rights apply in addition to the PACMachinery AU 12-month warranty where relevant.
